Abstract: Rule of law in the society of socialist should be the rule of good law.The substance of rationality and formal rationality is the basic characterization of good law.The good laws of the domain of form of rationality should comply with the following elements: rooted in the specific national conditions of China;fit the value of the community look forward to;the reasonable emotion of citizens should be recognition legally; and the system should be clear and complete harmony.Only when the laws are consistent with this series of elements, the form can be ensure to be good laws,and the statutory law can be changed to the effective conversion.

摘要： 社会主义法治应该是良法之治。实质合理性和形式合理性是良法的基本表征。形式合理性视域内的良法应符合以下要件:植根于中国的具体国情;契合社会的价值期待;对公民的合理情感予以法律的确认;在体系上具有明确性与完整和谐性。只有当法律符合这一系列要件时,才能从形式上确保自身成为良法,并实现由法定之法向现实之法的有效转换。
