Abstract

摘要： 相称原则是电子商务隐私保护的基础性伦理原则,有助于合理处理消费者个人权益与公司利益、社会利益之间的关系。相称原则要求,在一般情境中,消费者个人隐私必须得到切实保护,在特定情境中,消费者个人信息的收集范围应当与电子交易的目的相称;隐私保护的力度应当与隐私的敏感度相称;当且仅当泄露或侵犯隐私造成的伤害远少于阻止泄露或侵犯隐私造成的伤害,泄露或侵犯隐私是正当的。
